I agree with CrystalSeer. First issue is a legal one. Report it immediately and get the urn and ashes back. Be sure to inform police the urn contains ashes and if/when it is returned, check and confirm they are there.
If memory serves, some crematoriums weigh and document the volume. If you want to be sure, get it weighed and compared.
Either way, worry about the spiritual once it is back. Perhaps consecrate the urn/redo any internment prayers, or otherwise welcome it back into your home as a place of peace, rest, and honoring.
Even if some ashes are missing, the good news is there are things you can do to prevent them from being useful magically if that is a worry. Ashes can be used as a direct connection for a spirit so they can be reached for summoning, sometimes binding, communication, or help in magical tasks. Think of it like having your hands on the classic 'red phone'. A direct line to the spirit they specifically belong to.
Also, if your father has moved on/already begun a new life then there is nothing to worry about. The person might try calling, but there will be nobody home.. so to speak.
